1. Provider, scope and incorporation
Your contracting party is Mayk Biletti, trading as ECOTRUCKS.EU, Sportplatzgasse 32b, 2443 Leithaprodersdorf, Austria, VAT ID ATU83766435. These terms apply only if supplied before contract conclusion and validly agreed. Individual agreements take priority. Mandatory consumer rights remain unaffected. The website currently provides no binding ordering function.
2. Offers and contracts
Website content and calculator results invite enquiries. Each individual offer describes the service, vehicle concerned, price, performance and timing. A contract arises through corresponding declarations by both parties. An enquiry or savings calculation alone does not create a paid order. Additional work and its cost must be agreed before it is performed.
3. Service scope and records
The agreed service is owed. Whether an order includes analysis, advice, vehicle work, software changes or file delivery depends on its specific description. Before technical work starts, the initial condition, affected systems, agreed changes and any backup or restoration arrangements must be clarified. Missing technical prerequisites are communicated to the customer. Further changes require an appropriate instruction.
4. Customer cooperation and vehicle condition
The customer supplies necessary information to the best of their knowledge and discloses known defects, previous modifications, software changes, lease restrictions and relevant warranty provisions. The customer must be authorised to commission work on the vehicle. ECOTRUCKS assesses feasibility within its professional duty of care and communicates foreseeable obstacles. Customer cooperation does not remove ECOTRUCKS’ own inspection, warning or care duties.
5. Legality, approval and insurance
The technical and legal suitability of each change and any inspections, approvals or registrations must be clarified before work and reflected in the order. General website statements are not promises of regulatory approval. Unlawful work, including unlawful circumvention of emissions or safety systems, is outside the offering. Contract terms cannot replace required official approval. Manufacturer warranty and insurance implications must be assessed for the particular vehicle; unchanged manufacturer cover is promised only where factually supported.
6. Consumption and savings
Calculator results rely on customer inputs and freely chosen assumptions. They are not individual performance promises or guaranteed payback periods. Actual consumption depends on route, load, driving, condition, auxiliary equipment and surroundings. If a savings target is contractually agreed, baseline measurement, comparison conditions, duration and evaluation must be recorded in the order. These terms do not restrict such an individual commitment.
7. Prices and payment
Prices and payment conditions are agreed before contract conclusion. Consumer prices include taxes and foreseeable additional costs. Business prices excluding VAT must be clearly identified. These terms alone do not authorise charges for unagreed additional work. Unless otherwise validly agreed, statutory rules apply to payment due dates, default and necessary collection costs. Statutory rights of set-off and retention remain unaffected.
8. Timing, delays and changes
Binding dates and any prerequisites are agreed individually. ECOTRUCKS communicates foreseeable delays, their causes and likely impact. Service changes require agreement; these terms do not permit unilateral material changes to the promised service or price. Statutory remedies for delay, non-performance or impossibility remain unaffected.
9. Handover, defects and statutory remedies
Completed work and known particulars are explained at handover. Please report apparent malfunctions promptly so they can be investigated. This request creates no additional exclusion deadline. Statutory defect remedies and time limits apply; legally applicable business inspection and notification duties remain unaffected. A commercial guarantee exists only when separately promised and does not restrict statutory remedies.
10. Liability
ECOTRUCKS is liable under the applicable statutory rules. These terms contain no blanket exclusion for engine, transmission, data or consequential loss and do not curtail mandatory liability rights. Causation, fault and any contributory fault are assessed under statutory rules. Operation must be interrupted and professional assessment arranged where a safety-related fault occurs. Both parties remain subject to statutory duties to mitigate loss.
11. Software, files and confidentiality
Where software or files are agreed, the offer must describe the purpose, vehicles and scope of permitted use. Legally permitted uses remain unaffected. Third-party rights and customer-supplied material remain with their respective owners. Confidential technical and commercial information is disclosed only for order fulfilment or where legally required. Personal data is processed according to the privacy information; these terms do not replace necessary consent or a data processing agreement.
12. Consumers: distance contracts and withdrawal
Consumers may have statutory withdrawal rights for distance or off-premises contracts, normally with a 14-day period. The required information, complete contract-specific withdrawal instructions and model form must be provided before contract conclusion. An early start must be requested separately. Loss of withdrawal rights for services or digital content depends on the respective legal conditions; accepting these terms alone is insufficient. This draft does not replace the contract-specific instructions still to be prepared.
13. Complaints and disputes
Complaints may be sent to info@ecotrucks.eu or the provider’s postal address. ECOTRUCKS reviews them using the order and technical records. This draft does not assert a duty or willingness to participate in a particular alternative dispute resolution procedure; that point must be clarified before use for consumer contracts.
14. Applicable law and language
Austrian law applies. Consumers retain mandatory protections of the law that would apply without this choice. Court jurisdiction follows statutory rules; no exclusive consumer jurisdiction at the provider’s location is agreed. The language version validly agreed at contract conclusion governs. Later website changes do not alter existing contracts. Invalid provisions have the consequences prescribed by law and are not automatically replaced with a maximally extensive substitute.
